The Supreme Court of India has officially stated that it will begin the physical hearings with multiple options from 1st September 2021. The Secretary-General of the Court has provided a Standard Operating Procedure (SOP) related to the same.
For the time being, the physical hearing will be restricted to final and regular hearing matters on non-miscellaneous days, that is, on Tuesdays, Wednesdays and Thursdays. As per the decision of SOP, all other matters, including those listed on miscellaneous days, shall continue to be addressed through video/teleconferencing mode.
Further, the SOP mentioned that in any such matter listed for physical hearing (with mixed option), all advocates appearing for one party could appear either through physical mode or through video/teleconferencing. Advocate(s)-on-Record are needed to register themselves on the portal of Supreme Court and put forward their preferences for appearing before the Court either through physical mode or via video/teleconferencing mode within 24 hours/ 1:00 PM next day after the listing of the weekly list of final hearing/ regular matters.
And once hearing via physical mode is picked up by the AOR or petitioner-in-person, addressing matters via video/teleconferencing mode to the party concerned will not be possible.
