In the year 2019, A CBI court found Junagarh’s MP and five others guilty of the murder and therefore sentenced them to life imprisonment. The MP filed an appeal in the HC against his arrest.
The Supreme Court prevented the Gujarat HC from hearing a criminal appeal by former Junagadh MP against his conviction to life imprisonment related to the murder of one RTI activist.
In the year 2020, SC has ruled quick prosecution in criminal cases pending against MPs and MLAs. The MP sought priority in hearing his appeal on the reasoning of the SC order, and the HC accepted to hear the appeal out of turn. The Activist fathers questioned the priority of hearing and moved to SC, stating that the MPs appeal should not be heard out of turn.
The SC stated that its order of expeditious proceedings was about criminal trials and nothing is related to the appeals, and it should be heard on account of its order. Due to a pending plea in the SC, the hearing was adjourned in the High Court. In the meantime, the MP has filed an application in the high court for adjournment of the sentence.
