The Delhi High Court observed that a father does not own the daughter to dictate terms, and every child has a right to use his or her mother’s surname (Vindhya Saxena v East Delhi Municipal Corporation). This observation was made while Justice Rekha Palli had declined to allow the plea filed by a minor girl's father who sought directions so that his name is reflected as the daughter's surname and not the mother's name.
It was contended by Advocate Anuj Kumar Ranjan, appearing on behalf of the petitioner (father), stating that the girl was a minor and does not decide these things for herself, and the name change will make it difficult to claim an insurance amount from LIC since the policy was taken in the name of the child with her father's surname.
Justice Rekha Palli, after hearing the petitioner at length declined to entertain the plea, concluding that it does not have merit and stated that the apprehension that the LIC will be dishonored is misconceived and was an attempt to somehow set a score with his estranged wife.
