The dispute in the present case claimed by the Appellant named Samir Kasal was this that the upcoming Legends League Cricket Tournament was the original idea of the appellant, who had put forth a suit before the Delhi High Court stating that since it was his idea to come up with this particular tournament wherein the retired players would play the game in a two-innings format and each team would bat for 10 overs in each innings, the credit of the same along with the copyrights goes to the appellant, due to which the appellant urges for a stay in the upcoming Legends League tournament. As the idea of the same had been discussed and disclosed with the respondent named Prashant Mehta, the appellant contends that his idea was stolen by the respondent and the other defendants who went on to collaborate on the same and started the particular tournament.
The Court in this matter opined that there have been various formats of playing this particular sport that has evolved over a period of time, and that it would be unreasonable to distinguish a 5-day test match series to the recent T20 Matches, which therefore leaves no scope for anyone to claim copyright over the same, and this also includes the venue, duration, players, as well as the length of the matches.
The Court further went on to state that the initiation of a 10-over cricket match is not a concept that has come to light recently, as it’s been in practice since 1997 in New Zealand, and under this format there have been various retired players playing matches all around the world. Therefore, the Court after much perusal on the matter, adjudged that the idea claimed to be solely of the appellant is clearly not the case here and that no one has the right to claim copyright over the game of cricket, as a result of which there will not be a stay on the Legends League Cricket.
